Internet Service Terms and Conditions
Agreement by and between Network Professionals Inc (“Net Pros”) and the applicant customer identified on the front of this Wireless Internet Service Contract (“Customer”).
1)Use and continued use of any and all Internet & Network services provided by Network Professionals, constitutes full acceptance of these Terms and Conditions without exception.       
2)Net Pros delivers to Customer the equipment and service identified on the front of this application. All  equipment will remain the property of Net Pros and Customer shall not permit the equipment to become subject to any liens or encumbrances whatsoever. Installation costs are nonrefundable.
3) Customer acknowledges that Customer has received the equipment and agrees that the equipment may only be used at the address set forth on the front of this work order and may be used by Customer as permitted by Net Pros in connection with the reception or use of services provided by Net Pros. Any customer allowing others to access this connection from anywhere other than the address stated in this contract , whether for payment or not, will be subject to immediate dismissal of service. Further, customer will be personally liable for any damages which occur directly or indirectly from allowing said access, and will be held financially responsible for any cost incurred by Net Pros relating to said damage
4) Customer will be responsible for all applicable charges until the equipment is returned to Net Pros.
5) Upon termination for any reason of Net Pros services Customer must promptly return all Equipment to Net Pros in good condition. If Customer fails to return any item of equipment to Net Pros upon termination, Customer agrees to pay Net Pros for each item of Equipment not returned, plus any collection costs that maybe incurred.
6) Customer bears the risk of loss of equipment from the time it is delivered to Customer to the time it is returned to Net Pros. If any item of equipment is lost, stolen, damaged, or destroyed during such time period then Customer will be responsible (except to the extent any damage or destruction is caused by the gross negligence or willful misconduct of Net Pros) and will pay Net Pros, for the cost or repair (if repairable) or full replacement cost (if not repairable or missing).
7) Customer must notify Net Pros promptly of any equipment failure or malfunction.
8) Certain equipment may be subject to third party warranties, which may be passed through Net Pros to you at no additional charge. Net Pros will comply with all reasonable requirements necessary to affect the pass-through of the warranty to you at it’s sole option within the initial term, Net Pros or it’s agent may replace a defective modem or gateway on behalf of the manufacturer, provided you follow all applicable procedures and obtain a return materials authorization (RMA) number. This warranty does not cover defects resulting from acts outside of Net Pros control, use contrary to specifications or instructions, or repair or modification by anyone other than Net Pros or its contractor. Net Pros reserves the right to modify this warranty at any time. The services are provided on an “as is” and “as available” basis. Net Pros does not warranty that the service will be uninterrupted and free of errors, viruses, or other harmful components. Net Pros makes no express warranties and waves all implied warranties including but not limited to, warranties of title, non-infringement, merchantability and fitness for a particular purpose regarding any merchandise, information or service provided through Net Pros or the Internet generally. No advice or information given by Net Pros or its representative shall create a warranty. Net Pros and its employees are not liable for any costs or damages arising directly or indirectly from installation of the equipment, your use of the services or the Internet including any indirect, incidental, exemplary, multiple, special, punitive, or consequential damages of any kind (including but not limited to lost data or profits or any other damages whatsoever whether or not advised of the possibility of damage, under any theory of liability). Net Pros shall have no liability whatsoever for any claims losses, actions, damages, suits, or proceedings, resulting from: other users accessing your computer, security breaches, eavesdropping, denial of service, interception of traffic sent or received using the services; your reliance on or use of the equipment or services, or the mistakes, omission, interruptions, deletion of files, errors, defects, delays in operation, transmissions, or any failure of performance of the equipment or services.
9) Customer acknowledges that Internet speed levels offered are labels that mean up to and including the noted speed level and that Net Pros provides no guarantee of speed levels over the public network known as the “Internet”.
10) The bills you receive will show the total amount due and the payment due date. You agree to pay us in full, by the payment due date for that service and for any other charges due us.
11) Upon signing on this contract Customer agrees that there was no damage to their premises or any other property during equipment installation or any other time cause by Net Pros.  
12) 50% of the remaining contract amount will be billed for early termination of contracts.
As a subscriber of a wireless service, you are entitled under federal law to know the following:
1) We keep regular business records that contain your name, address and other personally identifiable information “Personally identifiable information” is information that can be matched with a person’s identity such as a customer’s address, personal interest, activities, spending habits and significant relationships. Such records include billing, payment and deposit records, and the service options you have chosen. We use this information to make sure that you are being properly billed for the services you receive. We also use this information for billing, provision of customer service, network management, customer analysis, subscriptions, provisions of terms of related services, exchanges of information at web sites as well as for our own tax accounting records. We will only use your personal information in a way that is fair.
2) We consider information we keep to be confidential. We will put in place appropriate technical and security measures in order to prevent unauthorized or unlawful access to or accidental loss of or destruction or damage to this information. We may collect personally identifiable information from you and may disclose it to a third party if (a) you consent in advance in writing or electronically, (b) disclosure is necessary to render services we provide to you and related business activities; or (c) disclosure is required under a court order or subpoena.
3) We will use information received in e-mail from you, customers and other individuals only for purposes reasonably related to the subject matter of the communication.
4) We may also electronically test the system form time to time to determine whether you are being properly billed for the wireless Internet services you are receiving.
5) We will maintain information about you for as long as we provide service to you and for a longer time if necessary for related business activities. Ordinarily, for accounting and tax reasons, we keep records for 6 years. When information is no longer necessary for our purposes, we will destroy the information unless there is a legitimate request or order to inspect the information still outstanding.
6) You have the right to inspect records that contain information about you, correct any errors in our information and enforce your rights under federal law, including, the right to recover statutory damages and coats.
